Posted September 14, 2018 If subject (A) is arrested without being read his or her rights, and officer (A) arrests subject (A) on murder charges, What do you do in essence of a defense? What would be the outcome? -Allen Camel

However it can be spun to show the officers lack of training and misconduct, which can be used in the defendants favor, since it will lessen the confidence in the cops work. The exact outcome on such a situation is hard to determine from the given info, as there are lots of factors, but the act of not reading the rights alone won't dismiss the validity of a case. The only affect it has by law is that the cop can't use statements from the subject as evidence, and can't use any evidence obtained through the information gotten by the subject. I hope this answered the question. Best regards Jepp Shady Inc Edited September 16, 2018 by jeppevinkel

I am involved with law in real life, and if you knew how many people online think that failure to mirandize your suspect automatically results in the entire case being thrown out, you'd laugh. Sure would make it easy if that was the case, but I wouldn't try to answer law related questions without at least a bit of research first. Not even in a game.
