Preamble: We the People of the Republic Party, in order to provide an official and representative state for the citizens of the state and members of the party, and to establish justice, insure domestic equality, promote the general welfare, and secure the people in a free, fair, and just society, do ordain and establish this Constitution for the People’s Republic Party. ARTICLE I. The Republic’s System The People’s Republic Party shall be an indivisible, secular, democratic and social Republic. It shall ensure the equality of all citizens before the law, without regard to race, national origin, religion, disabilities, or sexual orientation. It shall not make laws favoring one religion over another and shall respect all beliefs. It shall be organized to reflect the People’s will and their wishes. Statutes shall promote equal access by women and men to elective offices and posts as well as to position of professional and social responsibility. Section 1.01 This Constitution establishes a direct democracy system whereby the people shall direct and inform the government of its will. This Republic System shall include mixture of socialism and federalism so that all people may enjoy a life of freedom, happiness, and the pursuit of liberty. Section 1.02 The Republic shall have a mixture of state and federal government combined to make one government. There shall be three branches of government and shall include three heads of these branches and their responsibilities and rights given to them by the people established in this constitution. Also established in this constitution shall include all of Identity Island as one government with its own state leaders. Section 1.03 The Republic shall make polices in the favor of a democratic- socialism state but shall not as established in this section make a full transition to communism which does not exist in this system of governance. Section 1.04 The name of this government shall be known as “The Republic” or “the Federal Government of the Republic” Section 1.05 The People’s Republic Party shall not be managed by the President or his or hers administration but shall be managed by the People who shall elect two citizens to serve as the Party’s Chair and Vice Chair. These positions shall not weld any powers over the government or the three branches. Article II. Structure of Government This Constitution shall establish the three branches of government. Section 2.01 The People’s Republic Party shall consist of three separate branches of government: legislative, an executive, and a judiciary. Section 2.02 No citizen shall simultaneously hold office in more than one branch of government. Section 2.03 To protect the separation of powers of each branch of government, no person holding office in one branch of government shall be accountable to a person holding office in a separate branch of government, except as provided by this Constitution. Article III. Legislative Branch The Republic Party shall under this constitution establish the creation of the Legislative Branch which shall bestow its legislative powers exclusively to the General Assembly. Section 3.01 All legislative powers herein granted shall be vested in a General Assembly of the People’s Republic Party. This shall be a separate branch under the party and shall have its own elected parties under the people. Section 3.02 Representation Clause 1: Each individual within the Republic shall have equal representation in the Senate according to the proportion of citizens within the Republic State. Clause 2: Members of the Republic Senate shall be entitled as Senators and shall only hold one vote per bill in the Assembly. Section 3.03 Elections for senate positions shall be held once every six (6) months. Section 3.04 Senators elected shall serve a six month term commencing with the call to order of the first Senate meeting in January and terminating at the call to order of the first senate meeting in July or at such a time as a duly elected senator involved in a disputed election is eligible to serve. Section 3.05 Vacancies Clause 1: Senatorial vacancies shall be filled by appointment by the people via vote and they shall serve until the next regularly-scheduled election; Clause 2: Citizens appointed to fill the senate vacancies shall complete the terms of the positions to which they are appointed; Clause 3: If a senate vacancy shall remain open beyond three consecutive regular meetings of the senate, and the people fails to nominate an eligible candidate for the vacant position, the President shall have the power to fill the position through the procedures as defined by law. Section 3.06 Speaker of the Senate Clause 1: The Speaker of Senate shall be the presiding officer of the Republic Senate; Clause 2: The Speaker of Senate shall not be a member of the senate but is instead a citizen elected to the office by the people; Clause 3: The Speaker shall appoint the chairpersons and members for each standing committee of the Senate; Clause 4: The Speaker of the Senate, while in office, shall not receive compensation for his or her duties. The Government shall not initiate any payment for this office. Section 3.07 The Senate shall have general legislative powers including the following: Clause 1: To approve and/or amend the federal budget of the Republic Government; Clause 2: To approve committees, commissions, or boards as needed to perform the functions of the government; Clause 3: To prescribe times, places and manners of holding elections; Clause 4: To establish lower tribunals not set forth in this Constitution, which shall be subordinate to any judiciary established herein; Clause 5: To make laws which shall be necessary and proper for carrying into execution the foregoing powers and all powers vested by this Constitution in the People’s Republic Party. Section 3.08 Meetings Clause 1: The Senate shall convene at least once every two weeks. These meetings shall take place on a Friday unless otherwise provided by law; Clause 2: The Senate shall keep minutes of its meetings current and available to the public; Clause 3: The Senate shall publish a bound copy of its proceedings (hereinafter referred to as the Senate Review) at the end of each session to be permanently located on the Republic's government website and offices. Section 3.09 Legislation Clause 1: Legislation pursuant to a fundamental policy of the People’s Republic Party which shall before becoming law, be presented by the Speaker of the Senate within five (5) working days to the President of the Republic. Article IV Executive Branch Section 4.01 The power of the Executive Branch is vested in the President of the Republic, who shall act as head of state and Commander-in-Chief of the armed forces. The President shall be responsible for implementing and enforcing the laws written by the People and, to that end, shall appoint the heads of the federal agencies, including the Cabinet. Section 4.02 The President of the Republic shall be elected by a majority of the citizens of the Republic. Presidential candidates shall name a Vice Presidential candidate with whom they shall run for office jointly. Election ballots shall require citizens to vote for an executive ticket consisting of a presidential and vice presidential candidate. The President and Vice President shall serve a term of one year commencing on the first day of January and terminating the following January. Section 4.03 The President shall be the chief executive of the Federal government and shall have broad powers to manage the national affairs and priorities of the government but shall be responsible to the people regarding legislation and shall have limited authority on legislation. Section 4.04 Powers and Duties of the President of the Republic: Clause 1: The President shall be the head of state and head of government for the Republic and shall appoint heads of the Republic federal departments. Some departments shall require the Assembly’s advice and consent; Clause 2: The President may, at his discretion, create commissions, committees, and boards and may assign duties of those groups established in this clause, in order to assist the President in meeting the needs of the people and enforcing the law; Clause 3: The President shall submit laws to the people with advice and consent from the General Assembly; Clause 4: The President shall act as the official representative of the People when promoting the Republic’s interests abroad; Clause 5: The President shall have the power to either to sign legislation into law or to veto bills enacted by the General Assembly, however, the General Assembly shall have the power to override this veto with a two-thirds vote; Clause 6: The President of the Republic shall sign the ordinances and decrees in the form of Presidential Executive Orders or Presidential Memorandums and shall have the force of law upon his or her signature. He shall make appointments to the civil and military posts of the State. Section 4.04 The Vice President shall direct and oversee the government’s investigative departments and bureaus with advice and consent from the President and the General Assembly. Section 4.05 The Secretary of Commerce shall be appointed by the President of the Republic with the advice and consent of the Assembly and shall serve in the President's Cabinet. The Secretary shall be tasked with promoting businesses and industries within the party and state. Section 4.06 The Secretary of Homeland Security shall be appointed by the President of the Republic with advice and consent from the Assembly and shall work with the civilian state law enforcement to protect the People within its borders. The Secretary shall serve in the President’s cabinet. Section 4.07 The Secretary of Education shall be a member of the President’s Cabinet and shall be appointed by the President of the Republic with the advice and consent of the General Assembly. The Secretary shall be tasked with advising the President on policies, programs, and activities related to the education within the Republic. Section 4.08 The Secretary of the Treasury shall be a member of the President’s Cabinet and shall be appointed by the President with the advice and consent of the General Assembly. The Secretary shall be charged with advising the President on financial and monetary matters. Section 4.09 The Secretary of Housing shall be a member of the President’s Cabinet and shall be appointed by the President with the advice and consent of the General Assembly. The Secretary shall be charged with overseeing the housing programs including stopping discrimination. Section 4.10 The Presidential Residence Clause 1: The President of the Republic shall work and live from a Presidential residence within Identity Island. Clause 2: Established in this clause, shall be the name of the residence where the President shall work and live for the duration of their term. The name of the residence shall be the Presidential Palace. Article V Judicial Branch Established under this Constitution shall be the Judicial Branch of the People’s Republic Party which shall consist of a supreme body known as the Republic’s Supreme Court. Section 5.01 There shall be a Chief Justice who shall lead the Judicial Branch and shall issue legal opinions as the head justice. There also shall be three Justices known as Associate Justices who shall assist the Chief Justice in hearing the cases. Section 5.02 All lower courts created by law or necessity as determined by the Chief Justice shall be considered subordinate of the Judicial Branch. Section 5.03 The Justices and Chief Justice shall have a fixed term limit serving a one year term. Section 5.04 In the event of a vacancy, the Justices of the Supreme Court shall be appointed by the President with the advice and consent of the General Assembly. The President shall appoint with the advice and consent a Chief Justice from the membership of the Supreme Court. Section 5.05 The Supreme Court shall have original jurisdiction over all cases in the government excluding cases at the state levels. Article VI Bill of Rights Section 6.01 The equality of all persons before the law is recognized, and shall ever remain inviolate; nor shall any citizen ever be deprived of any right, privilege or immunity; nor exempted from any burden or duty, on account of race, religion, disabilities, or sexual orientation. Section 6.02 The right of the people peaceably to assemble, to consult for the common good; and to petition the government, or any department thereof, shall never be abridged. Section 6.03 The government shall not make laws establishing, endorsing, or prohibiting religions. The government shall not make laws prohibiting free speech or the press. Article VII Impeachments Section 7.01 Elected officers of the three branches shall be impeached by the People via direct majority if: Clause 1: The People deems the actions of the three Branches illegal or unconstitutional. Article VIII Amendments Section 8.01 The Amendments shall take effect following the acceptance of the majority in a authorized election. Section 8.02 Amendments shall become a part of the Constitution when ratified by the People. No branch of this government may approve of the amendments ratified, that authority belongs exclusively to the People via direct democratic vote. Article IX Ratification Clause: This Constitution shall take effect on following the acceptance of the Founder’s signature. I, Anthory Falley, hereby grant this Constitution and its contents valid and true to the best of my ability What is the Republic's System in the People's Republic Party? The system itself is a federal social democratic state with a social welfare state economy. Unlike many of our counterpart governmental systems within Identity, we do not consternate executive, legislative, and judicial powers under one party. The party does not control the day to day operations of the government or the structure of the system itself. It is a hub for the people (citizens of the Republic) to use their new found right to directly inform the government of its will, however, IT IS NOT a Marxist-Lenin-Maoism system or a communism state party. The President under our Constitution is the chief executive of the federal government (not the head of the party itself) and is responsible for carrying out the laws of the Republic while the General Assembly makes and passes the laws with the consent of the citizens. No laws will be passed without the citizens consenting to it. The Judicial Branch interprets the law and deems any law constitutional or unconstitutional. The system is very similar to the United States version but in our system, the people controls the government completely through their direct democratic right to affect change. What makes our system different and unique is that we use a parliamentary representative system but we also use a direct democratic system where only the citizens have the final say on their laws passing or not after it has passed the Assembly. The People are also encouraged to participate in amendments passing and impeachment proceeding for the two branches of government (Legislative and Executive) but it also comes with a price. The Supreme Court can halt the citizens votes if the court deems the laws passed unconstitutional. This puts a check on the People's voting powers. The President can also veto the votes by both the Assembly and the People but this veto can be overridden by both parties.
  2. You have a fundamental misunderstanding of our system friend and you haven't read the full document. The majority's power in this system will be in check by the party's representative. So even if the majority votes on a policy that's terrible, if it is not within the constitutional bounds, it will be overturned by the Party Rep, thus it cannot be law. And the majority can't override the veto. You are also factually incorrect on your assumption that you could commit murder and get away with it in this system, yeah no. We have a department in our system that enforces the law and that department is led by yours truly. Secondly, no freedoms have been restricted under our system. You haven't read our entire constitution or its rights, or you would have known that. Every one of our people gets universal freedoms including these rights: 1. Freedom of Expression: Each and every citizen shall possess the Right to express their opinion to the public, excluding hate-speech that may provoke acts of violence within the nation. 2. Right to Food: Each and every citizen shall possess the Right to attain a three-course meal during the day. 3. Right to Water: Each and every citizen shall possess the Right to sanitary water. 4. Right to Shelter: Each and every citizen shall possess the Right to possess a dwelling place with a heating/cooling system, a bed, a fridge, a stove, and a roof over their heads. 5. Right to be Clothed: Each and every citizen shall possess the Right to possess clothing in order to survive the cold and/or warm environments. 6. Right to Energy: Each and every citizen shall possess the Right to possess energy within their dwelling place, including fuel for their vehicles. 7. Right to Healthcare: Each and every citizen shall possess the Right to a doctor, hospital bed, and medication. Did you even read the entire thing before you made these grandstanding statements? And one more thing, stop trolling. If this isn't your kind of system, find one that's suitable for you. I'm sure there are other political parties and systems of governments for you to choose from but for the love of god, stop trolling.
